PENGATURAN HUKUM TERHADAP HUTAN SOSIAL DI INDONESIA MELALUI PENJAMINAN ASPEK LEGAL

Kontribusi antropologi hukum terhadap pengembangan ilmu hukum di Indonesia berfokus pada masalah hukum kehutanan, implementasi program hutan sosial, dan peran Yuridiksi Hutan Sosial dalam penegakan hukum kehutanan. Dengan menerapkan pendekatan interdisipliner—menggabungkan perspektif etnografi, analisis institusional, dan studi kasus—artikel ini menunjukkan bagaimana metode antropologi hukum (observasi partisipatif, analisis wacana, dan studi praktik hukum sehari-hari) dapat memperkaya pemahaman atas norma-norma hukum formal dan praktik lokal, menjembatani jurang antara regulasi negara dan keberlanjutan sosial-ekologis. Studi ini menilai tiga bidang utama: (1) pemahaman pluralitas norma di wilayah hutan; (2) dinamika akses dan partisipasi komunitas dalam skema hutan sosial; dan (3) kebutuhan pengembangan kapasitas Yuridiksi Hutan Sosial yang sensitif budaya untuk memetakan konflik dan pencegahan kejahatan lingkungan. Temuan menunjukkan bahwa integrasi metodologis antropologi hukum pada proses perumusan kebijakan, implementasi hukum, dan mekanisme Yuridiksi Hutan Sosial akan meningkatkan legitimasi, kepatuhan, dan efektivitas penegakan hukum kehutanan. Rekomendasi akhir menyarankan agenda penelitian, reformasi kelembagaan, dan pedoman praktik untuk memasukkan perspektif antropologi hukum dalam tata kelola hutan dan strategi hukum.
